Terms and Conditions

These terms and conditions are applied to all programs offered by Travel Utsjoki Ltd for private consumers. These terms and conditions shall be governed by and construed in accordance with the Finnish Law. The Finnish Courts have the exclusive jurisdiction to settle any dispute, controversy or claim related to such a demand.

Prices

Prices and the services are explained in the program descriptions on the webstore and order confirmation. Travel Utsjoki will always send a reservation confirmation for the consumer after the reservation. Payment options are presented in the webstore. In most programs, children younger than 12 years get a 30-50 % discount on the prices, depending on the program. The given prices include VAT as the Finnish Taxation Legislation regulates. Travel Utsjoki has the right to change program prices if any unforeseen increases in costs that are not in control of Travel Utsjoki Ltd, such as taxes or fuel costs.

Cancellation Policy

All programs require a number of minimum 2 participants. If consumer cancels taking part in reserved program 7 days or more before the tour scheduled time, a charge of 10 % will be made to cover the office expenses. If cancelled by consumer in less than 7 days before the scheduled tour or not showing up at start/meeting point at scheduled time, 100 % of the value of the confirmed order will be charged (unless a health-related reason with doctors statement). Guests are responsible to make sure they have all needed documents to cross border for taking part on tours if attending programs in Norway. If the tour is cancelled because of extreme weather conditions or less than 2 participants on tour, a 100 % refund will be made for consumer as a bank transfer, if taking part in a re-scheduled tour is not possible. Travel Utsjoki reserves the right to change program routes, number of participants and schedules due to safety reasons. Travel Utsjoki reserves the right to refuse a participant from participating in agreed program, if their physical or mental state or being intoxicated is a safety risk for them-selves or other participants. No refund shall be made if customer has not informed about health limitations affecting capability to take part in program. Taking part in programs under influence of alcohol or other drugs is prohibited.

Liabilities

Travel Utsjoki follows the Finnish laws and regulations and standards of program service safety at all times. Consumers responsibility is to follow the given instructions. Travel Utsjoki has a general insurance for bodily injury and property damage, but all passengers are highly recommended to have a personal travelling insurance. Travel Utsjoki has the right to prohibit a consumer taking part in programs if under influence of alcohol or drugs and discontinue a program if a participant is seen as potential danger or is in poor health. Consumer is responsible for providing the service provider with all necessary information asked on the reservation form (etc. health, allergies, restrictions of movement, pregnancy). Travel Utsjoki will inform the consumer if any of their conditions restrict taking part in the program or if special arrangements are needed and if there is an extra cost for this (for example, if an extra guide is needed for assistance of mobility issues). Travel Utsjoki may only be held liable for injuries or material damage during the programs, which are caused by negligence of Travel Utsjoki personnel or faulty equipment. Travel Utsjoki is not liable for any accidental damage. Consumer has to notice that programs take place in nature and with animals, and all safety instructions have to be followed. Consumers always take part in programs with their own risk.

Force Majeure

In case of Force Majeure (such as war, strike, weather, natural conditions), neither party shall be held liable for any damage or loss caused by the force majeure. In case of force majeure condition, immediate notification has to be made to other party in writing and all reasonable steps available should be taken to minimize the effects of the force majeure on the contractual relationship between Travel Utsjoki and the consumer.
